Who does Wal-Mart think they are keeping someone from opening a restaurant in the old Golden Coral building? Because they are going to serve alcohol. In the mid-west Wal-Mart sells liquor and liquors, this one and all of the ones around here sell beer and wine, the restaurant is not a threat to their business, so I have to believe that this is just a power trip on the part of Wal-Mart. I am going to be calling the local Wal-Mart Manger and voicing my opinion. Maybe if enough people do this and show support for a new local business they will have a change of heart. I think that we should do everything we can to try and help this business out

Corporate Wal-Mart did not return our calls for comment.
All Wal-Mart would need to to is give thier side of it , i buy just about everything at Wal-Mart but this is just wrong

What about any correspondence from Wal-Mart on the matter?
Seems a good reporter could get more info than that article had.

Maybe that's what it means a restriction for the rest of the shopping center. That way there is no competition for Wal-Mart.

If the alcohol business is the reason and all this is true, it just doesn't seem right. It's not like customers are going to buy a six pack and a box of frozen hot wings from Wal Mart and sit there and eat them. Just like we can't go and buy a six pack from a restaurant. Totally different businesses we're talking about, no competition issue here! What's the deal???

Ok then maybe they don't want the drunks from the restaurant hanging around their store.
The point is Kimco Realty and Wal-Mart signed the lease with the restrictions now Wal-Mart wants the lease adhered to and their the bad guys.
IMO that's a bunch of BS

The bottom line is, they don't have to give a reason. It is in the lease, and Wal-Mart wants to exercise this option. It is all quite legal and enforceable. The restaurant can go elsewhere and set-up. If you don't like it, that's okay, and you have the option of not patronizing Wal-Mart, complaining to their BOD, writing letters to the editor, etc. but I see no reason to think it is not legit/legal action on their part.

I was walking out of Wal Mart in M'burg last night. I walk fast so I zipped around this lady and her kid. Really loud, the mom goes, "JESUS CHRIST I'M GOING TO HAVE TO WALK ALL THE WAY OUT THERE TO THE F'ING CAR!?" As I continued to walk further away I could still her cursing and her daughter was right there.
I wanted to grab her by the throat and call her a loser and then scoop her poor child away.

That's exactly it Wal-mart sells alcohol for their customers to take home and consume at home. The restaurant's customers will be imbibing and then driving immediately afterwards, endangering everyone in their path, which includes Wal-mart's customers. If the lease says no alcohol, then no alcohol, period.

So essentially you're saying that any restaurant serving alcohol shouldn't be in the immediate vicinity of any store, or other public place, where customers might be walking/driving. Should all restaurants serving alcohol be rounded up and moved to a certain section of town? Or maybe they should all go within that city wall you spoke of?

Not at all. I am however saying that patrons leaving restaurants after consuming alcohol do pose a definite, if small, risk to the rest of us. Not enough that I think that you addicted scum would ever allow a law to be passed keeping you from your drug of choice.
If Wal-Mart has a lease that says the restaurant isn't supposed to serve alcohol, then I can understand their desire to enforce it. I'm not saying we should pass a LAW banning all alcohol sales at restaurants, but I AM saying that property owners have a right to set whatever limits they want on their tenants as long as they don;t offend a protected minority, and drunks (excuse me - "people who choose to consume alcoholic beverages") aren't a protected minority.

it's not the property owners that put the clause in there. It was Walmart, the tennant that added the clause. I have a feeling that there might be a parking issue if someone new were to move into that building.
Walmart doesn't want parking spaces taken up by a new restaurant/bar that would definately attract a large loyal diner base. So they point out that their lease has a "we dont want our customers to have to compete for parking spaces" clause and it's done and done.
The least they could do is tear down the structure and make more parking spaces out of it...
I personally think the building looks like poo-poo. It's a total eyesore. Golden Corral didn't even bother to take down the last message on the marquee.

I can't see why you would think it was a parking issue, it is not like anyone is parking in the spaces around the old Golden Coral building and walking to Wal-Mart. Another question I have is why would the property owner agree to lease the building to the gentleman wanting to open his business? They knew of the clause in there lease agreement with Wal-Mart. i know it is in their lease but with them (Wal-Mart) selling alcohol i think it should void that part of their lease. I have also emailed NBC25 to see if they are going to do a follow up on the story, in hopes that they will

Whether you are capable of grasping the concept or not, there is a difference between selling acohol for consumption ON the premises versus OFF the premises. In my opinion, Wal-Mart's selling alcohol for people to take home with them has no bearing whatsoever on the issue at hand.

Why? Just because you say so? The provisions of the lease ought to be clearly written. Usually such things are written so that violation of any one part does not render the other part unenforceable, so unless they have a poorly-written lease, what YOU say should be should in fact, not. In any event, whatever the lease says is what goes... it's not subject to your (or my, or anyone else's) half-baked opinions, it's clear and simple legal language.

My point is this whole thing is governed by the language of the lease. If Wal-Mart got their landlord to sign a lease that gives Wal-Mart the power to tell everyone else in the shopping center what to do, then I say more power to 'em! Regardless, none of our opinions either way matter for anything. The lease says whatever it says and is a legal contrract and therefore ought to be obeyed. That's just the way it is.
The whole notion that any of your opinions should matter when it comes to a matter of enforcing a legally-binding contract is just plain stupid.
