Full Version: Two brothers face charges after theft of waitress's tips

BERKELEY COUNTY, WVa. - Two brothers were arrested Thursday after one took a waitress's tip jar from the Hangar Club on Kelly Island Road, according to a news release from the Berkeley County Sheriff's Department.


Melvin Warren Heartley, 27, grabbed a waitress's tip jar after she angered him, police said. He ran out to a vehicle that Eric Michael Heartley, 22, was warming up but as the two men were fleeing, their vehicle got stuck in the snow, police said.


The two men fled on foot but were later found on the east side of the train tracks heading to Pheasant Ride mobile home park, said police.


The tip jar was found in the bed of a truck parked outside the Hangar Club. Police said that Melvin Heartley threw the tip jar into the truck. Eric Heartley, of Falling Waters, W.Va., was charged with obstructing an officer but did not know that Melvin Heartley had planned to take the tip jar, police said. Melvin Heartley, of Martinsburg, was charged with petit larceny, according to the release.
