I know everybody's tired of reading about this, but I'd like to hear your viewpoints.

I can't understand why the judge ruled against the mother wanting to take her daughter ( and grandson) back to Texas. Why bury them in the Bahamas where no family can visit regularly?

As far as I can tell from scanning the news, Anna did not have a written will about her burial desires. Just the word of her attorney saying what he thought she wanted.

If I were the judge, I would have told the mom to take her daughter (and the grandson) to Texas and let the family grieve.

Court Allows Challenge From Smith's Mom

WEST PALM BEACH, Fla. (AP) -- A Florida appeals court issued a stay Monday in the dispute over Anna Nicole Smith's body, ruling that her remains cannot be moved to the Bahamas until the judges hear a challenge from the starlet's estranged mother.

The Florida 4th District Court of Appeal agreed to hear Virgie Arthur's request to overturn a trial judge's decision giving control of Smith's body to the attorney for the centerfold's infant daughter. That attorney decided she should be buried next to her son in the Bahamas.

Arthur has been seeking to bury her daughter in her native Texas.

The court gave other attorneys in the case until 2 p.m. Tuesday to respond to the challenge.

Earlier Monday, Judge Larry Seidlin rejected Arthur request to reconsider last week's ruling, saying he wanted to preserve Smith's dignity by having the funeral as soon as possible. Seidlin declined to speak to reporters.

Smith died in a Florida hotel Feb. 8 at age 39. A medical examiner has yet to determine her cause of death.

Arthur's lawyer, Roberta G. Mandel, wrote in the appeal that Seidlin's ruling was an inconvenience because the mother would need a passport and airline tickets to visit Smith's grave.

Outside court, Mandel said Arthur was willing to take the fight to the state Supreme Court, if necessary.

"This mother is a mother who deserves the right to bury her child," Mandel said. "The trial court treated her as though she was nothing."

Ron Rale, an attorney for Smith's boyfriend, Howard K. Stern, said Arthur should honor her daughter's wishes to be laid to rest in the Bahamas.

"I believe the testimony was clear where Anna Nicole wanted to be buried, and anything that obstructs that, to complete her wishes as soon as possible, is sad," Rale said.

Milstein, the court-appointed attorney for Smith's 5-month-old daughter, Dannielynn, did not immediately return a phone message, and neither did the public relations firm representing him. He said Saturday that the funeral would not take place before Tuesday.

In the Bahamas, Supreme Court Justice Stephen Isaacs dealt only with procedural matters at a private hearing Monday to determine Dannielynn's guardianship, said Wayne Munroe, an attorney for Smith's estate there.

Isaacs scheduled the next hearing for March between Arthur and Stern, who is listed as the father on the birth certificate. The judge has barred Stern from taking the girl out of the Bahamas until a custody ruling.

Stern and two other men claim they are Dannielynn's father. Los Angeles-based photographer Larry Birkhead wants a Fort Lauderdale court to enforce a California judge's orders so he can get DNA samples from Smith's body and the baby. Frederic von Anhalt, the husband of actress Zsa Zsa Gabor, also says he may be the father.

Smith married Texas oil tycoon J. Howard Marshall II in 1994 when he was 89 and she was 26. The reality TV star and Playboy Playmate had been fighting his family over his estimated $500 million fortune since his death in 1995.

Yeah, I haven't been able to give much critical thought to this case since I heard the ME report last week that her body was decomposing rapidly. Eeeew. I had to go look at her Playmate of the Year issue again to remind myself how hot she was back in the day.

It seems to me that there needed to be a DNA test first and foremost. Did anyone notice one of the attorney's scooping up Larry Birkhead's water cup while he sat on the witness stand. Sneaky huh? There's DNA on that cup or was she just merely cleaning up!!!!

Another thing.......if you were vomiting and had the diarrhea and a fever of 105 would you be going from the Bahamas to Florida to pick up a yacht? I also don't believe that she would voluntarily want to leave her baby's side after what happened to Daniel. There must have been an important urgent mission here.

Why aren't the police actively pursuing her sons death at the hospital or if they are they are keeping it very low key, and also Anna's death with Stern's prescriptions by her side. What's up with that! There is so much going on here, it's hard to believe.

I'm also very angry that someone broke into their Bahama's home and stole their belongings. Is anyone doing anything to try to find the thiefs? That is just awful. No one had the right to do that and they should be prosecuted to the full extent of the law. Hopefully their things and Anna's paintings can be recovered.

Now that Anna is dead does she have no rights. To just let her lay there and slowly rot. How about a bill of rights for dead people. How horrendous! I feel so sorry for her. She didn't deserve any of this. Bless your soul Anna.

The woman was a lost soul. I saw an awful video that her "attorney/lover/partner" made while she was pregnant wiith her daughter where she is made up like a clown & you can hear Mr. Stern in the background stating this video will make alot of money & she looks stoned...

I wonder about the judge--he acted like a drunk...crying jag & all...and incomprehensible decisions...but then this is Florida, home of the crazy judges like in 2000...

The only party who seems to care at all is her mother...keep the body in the states--we have laws, and will need to probably re-examine her body at some point to prove or disprove her attorney's black hand in all this ....

I feel sorry for the baby, her son, and Anna...and her mother & father...siblings..it is just such a mess..but the last thing you want to do is release the body to the Bahamas....

I'm wondering, who the real father is at this point. You have men coming out of the closet, stating their the father. It doesn't look good for Anna image. But of course, I don't think she had a very good image to start with. Just because your pretty don't mean nothing. You could still have a few screws loose. They need to do the DNA test and get it over with. If I was Howard Stern, I would just go ahead and let them do the test and be done with it. Doesn't seem that big of a deal to me, unless he knows, he's really not the father. Only real person this is going to hurt is the child. Growing up without her real mother.

i Just heard on Fox news Thursday evening (last night) that Anna had 7 insurance policies all paid up and guess who the recipient is: They were left to her son Daniel, and 2nd in line is Howard Stern. Hummm, how interesting.

where's CSI when you need them? I call it motive..

My father told me the other day the real reason Anna Nicole Smith died. He told me it was a confirmed case of food poisoning from two 90 year old nuts.

What's really sad to is, The simple fact when she got down there, she was really sick. Never took her to the hostipal. I believe if they did she would still be alive today. They must thought she had the flu or something. The only person that this is going to hurt is her daughter. Who will grow up never knowing her mother. Yes she may see pictures, but that will never be enough to fill the void.

Larry Burkhead, he was pretty happy today. That's who I thought the father would be. Once Howard Stern, said he wasn't going to fight for custody and few weeks back or something like that. Hopefully they can start moving forward.

I just don't understand why they waited sooo long to do the paternity test. That's 7 months of that baby's life that she and the dad can not get back. I hope the bonding goes well. He seems like a proud papa.

Maybe Anna didn't want the real father involved for some reason. She was on so much drugs, she probably wasn't thinking straight. Hopefully something will be done about the doctor that presribe all them pills to her.

Am I the only one that is sicken by this. I figure that a movie would probably be made, but I didn't think it would be talked about so soon. To make money off of someone death, I think that's horrible. Beside most people know what kind of life she lead. There's not a huge big secret there.

When Anna has that reality show, I thought it was a bit off the wall. At times she didn't seem all together then.
