"Kill cops" rant lands man in jail

QUOTE
Friday, June 27, 2008 | 10:33 AM By David HenryPHILADELPHIA - JUNE 26, 2008 (WPVI) -- 44-year old Andre Moore is being held at the 18th Police District by the very officers he apparently wanted to kill. At least that's the message he allegedy sent out to the world in a disturbing, hate filled rant on YouTube.

"When you shoot the cops, you shoot them dead.", Moore is heard saying. Moore allegedly posted this video on the internet demonstrating how to use a Colt .275 to shoot cops.

What police also find disturbing is that Moore is employed as a security guard at Einstein Medical Center, the hospital where Officer Chuck Cassidy died of gunshot wounds six months ago.

"We lost three police officers to guns on the streets of Philadelphia, and this idiot's out there promoting this message.", said Thomas Burke, of the Pennsylvania Gun Violence Task Force.

Moore's anger is directed mostly at the 18th district where he was cited for minor offenses last month. "I can't stand the 18th district," the videotaped rant continues. "That's why I rejoice whenever they shoot a cop in Philadelphia. 'Cause I hate them."

And Moore dosen't stop there. He goes on to promote violence in a city that is struggling to turn the tide. "Continue killing the 18th district police. I promote violence in Philly. Promote violence in Philly."

Moore faces a number of charges, including aggravated assault. And he's charged with corruption of minors. That's because the cameraman is his 12 year old son. And his son's 14 year old friend is seen in a follow up video posted just yesterday.

Police used a battering ram on his door at six this morning. Moore's wife is also a security officer, and doesn't want her face shown.
She says she was outraged when she learned of the video this past Saturday.

"I am very upset. I'm upset at him. How dare he jeopardize our family, and jeopardize my career?"

This case will be watched very closely as it moves through the court system. It could set a precedent. Legal experts tell Action News the arrest, based on an internet video, is questionable in terms of First Ammendment Constitutional rights. The D.A. says free speech ends when you incite others to shoot police officers.

Reaction to video "We lost three officers in this city to guns. It's outrageous for him to be promoting this message," says Thomas Burke, of the Pennsylvania Gun Violence Task Force.

Action News Reporter David Henry spoke to Moore's angry wife through her door. "I am very upset at him. Very angry. Why did he jeopardize our family? Why did he jeopardize my career?" she screamed.

Moore was cited for minor offenses in the 18th district last month. Now he's behind bars for some major crimes, including aggravated assault, making terroristic threats and corrupting a minor. That charge is because the video was allegedly taped by his 12 year old son. But a Villanova law professor is skeptical that these charges will hold any weight in court.

Michael Carroll summed it up this way. "I'm not saying this is popular speech or that this is a responsible opinion. It's clear people are going to be upset by it, but that doesn't make it criminal." Carroll believes this arrest stems solely from Moore's speech and nothing else, and speech, regardless of how hateful, is protected under the First Amendment.

"If you go on the internet, on websites on YouTube, you're going to find white power videos advocating violence against African-Americans and Jews, so there's lots of hatred on the internet."

Carroll adds the aggravated assault charge may be the most questionable because Moore as far as we know, advocated, but never attempted to hurt anyone. The district attorney told Action News free speech ends when you incite others to shoot police officers. However, when we asked for a definition of aggravated assault, the office had no comment.

"When you start punishing people for what they say, " says Carroll, you're undermining the whole basis of freedom in this society."
The video has been removed from YouTube. The company says it violates it terms of use. Moore is expected be arraigned overnight.

I'm not sure how to feel about this. One one hand, this jackass is encouraging an already violent-filled city to continue shooting cops - and in front of his impressionable 12-year-old son no less.

On the other hand, where do you draw the line between freedom of speech and terroristic threats? It's a fine line, but I also think that once you start prohibiting free speech, many other freedoms will follow suit.

It's a tough call either way, IMO. unsure.gif

I say it's Free Speech.

Free speech by an idiot.

Unfortunately, being a douch-bag is not illegal.

However, I don't see why the cops can't keep a REAL CLOSE eye on Mr. Jackass without violating his rights.

So why are we going after Bin Laden for advocating violence against Americans?

AMERICAN rights are for AMERICANS.

Perhaps he should apply for citizenship.

I think we're going after Bin Laden because he actually followed through with his threats.

bin Laden didn't actually follow through with the threats it was his followers. I can't remember if the U.S. holds leaders of organizations accountable for the actions of their members. It's been a while since I researched that kind of stuff.
Area 51
<insert Bush comment here>

That means President Bush isn't at war with Irag and Afghanistan, It's his armies that are.

And along the same sentiment as Area 51, wouldn't that also mean that Charles Manson is not guilty? I believe that he never did any of the actual murdering and that he only instructed his minions to do so.

Yeah, you're right about that but a lot has changed since they put Manson behind bars (i.e. ACLU)
Mcgee
ACLU another bunch of crap
Idiot
Why is this even a question? I say lock his ass up and throw away the key.

He planned and knew his minions committed crimes. If your friend killed someone and you were the lookout you are guilty of a crime. If you hire someone to kill your wife, you didn't actually kill them, but you are guilty of something. If you are Charles Manson and are aware your followers are doing these things, and you are planning them, that's not different then hiring a bunch of killers.

Bin Laden isn't an American true, but more importantly I thought he took responsibilty for terrorist attacks. If he planned them or knew the people that planned to do them and advocated them then he is guilty just as Charles Manson and anyone else.

People are only mad at this guy because he wants to kill cops, as mentioned, it's ok for the white hate people to post on you tube, you don't see them getting arrested, maybe it's just because they wear disguises at their meetings. To me it's free speech, it's not slander, and it's not a personal threat. Is it even illegal to say you will kill someone, say I posted a video on you tube saying I wanted to kill John Smith, will I be arrested?

It's a slippery slope when you start arresting them for what they say on a video. How about "Cop Killer": http://www.youtube.com/watch?v=BSvD5SM_uI4...feature=related

And when I'm finished, bring the yellow tape
To tape off the scene of the slaughter
Still can't swallow bread and water

I don't know if they fags or what
Search a n* down and grabbin his nuts
And on the other hand, without a gun they can't get none
But don't let it be a black and a white one
Cuz they slam ya down to the street top
Black police showin out for the white cop

Just cuz I'm from the CPT, punk police are afraid of me

And when I'm finished, it's gonna be a bloodbath
Of cops, dyin in LA
Yo Dre, I got somethin to say

F**k the police (4X)

I tried to edit those, I may have missed something. If so I apologize.

We are ok with this, but not some guy talking on you tube about it? How is that not corruption of minors, anyone can pick up one of those albums, parental advisory or not. They can see it on you tube, hear it from their friends, anything. How is that any different from this guy. It's not.
Udmas
A lot of people were NOT ok with that crap when it came out.

This is post 9/11, though that shouldn't matter.

If the guy gets a good lawyer I thing he'll get off.
Ithlilian
But don't you think that those songs are a good comparison? The rappers didn't get arrested, so there is no reason that this guy should.

He sounds like an idiot, but that doesn't change anything. I hope he gets off.
Udmas
Yes it is a good comparison and I also hope he gets off.
