In this specific thread got it.

IMO being accused of being someone else vs. being openly called a “beeatch” or whatever the term was used is a big difference. I think the appropriate measures were taken. But I'll let Mod speak for themselves.

Slang was tossed around some was not slang big difference IMO.

Jelsey- "bite me" NOT slang.
Smokechaser- "attention whore" NOT slang.
Priness- "beetach" slang.
Jelsey- "beach" slang.
Modsquad- "azz" slang.
jburrs- "@$$" slang.

IMO the guidelines [ Do not attempt to guess or reveal some other member's real name] vs. slang plus assuming members of being someone else is inappropriate.

A few days ago i simply said "hello" in the shoutbox as WVDragonLady replied "hi un" now WVDragonLady is assuming Princess of being un. It seems everyone is un in WVDragonLadys opinion. I'm just pointing out facts here. NO hard feelings intended.

Maybe the solution to all of the nonsense is to follow the guidelines? I have this name my daughter signed up as "proudmommyof3" Once again after reading the guidelines i requested the other name be deleted.

If I had to take a wild guess though, I would have to wonder if they were just giving you enough rope to, "hang yourself," once again.

It's all so very personal now. I know you'll hate me for it, but I really think you would benefit a lot from seeking things out of your normal routine. Get mad at everyone. Scream and fight and yell at the top of your lungs, but maybe after that, you could take a walk by yourself and think about stuff that doesn't necessarily pertain to your normal worries. smile.gif

After reading all that was said about Un and nothing was done from the "Moderating Team" When they have had enough time to correct this on going situation but instead they grab popcorn and run than give Princess a public warning when other members more than crossed the written "Guidelines" as did the ModSquad. NOT one of the other members received a public warning. So I decided to call my Attorney just out of curiosity. I gave my Attorney my permission to go under my name "BoldWoman" and gave him my password. After reading all that was stated and how it was handled he did some research and e-mailed me what is below.

[As social networking sites forums and Internet blogs continue to increase in both popularity and use, the opportunities for defamatory and libelous actions increase proportionally. Defamation, sometimes called “defamation of character”, is spoken or written words that falsely and negatively reflect on a living person’s reputation. Slander is generally spoken defamation, while ‘libel’ is written. Blogs forums or social networks in which defamatory statements are written or recorded present several potential sources of liability and recovery for the person whose character was defamed. In cases where the defamation is proved, damages are presumed and often enforced with liberality.]

I really feel if the ModSquad would have followed the "Guidelines" NOT participated a long with the other members gave others public warnings I would have NEVER posted this! Hopefully this will wake up some people.

If I have correctly read the Guidelines as you state you have, then you too are in violation.

You are not to share your user name and password.

I of course will allow the authorities to decide whether you are in violation or not, as we all should since they are appointed for their candor and judgement.

Cheers.

I also violated them as I said with having a second name for my daughter after reading them I than requested that name be deleted. I will say on my behalf I would NEVER sit on here and ram somebodies character in the dirt just for kicks. I find this behavior unacceptable.

I'm in hopes that this will be an eye opener. I watched this forum for a few months posted here and there read through some very old post and watched this immature click that I myself would never want to be part of I find it silly. As it states in the "Guidelines" and I agree 101% [You don't have to agree, but when you disagree, you should do it without calling each other names.] If some members would follow only this rule I feel this would make a world of difference.

After watching this clusterf**k for 2 days and trying to bite my tongue I have to ask you (boldwoman) something before my head explodes!

1) What is your claim in this whole thing? Princess started the whole thing when she asked about another forum. This thread was started by lilmoms (innocently I might add) and the responses were all civil until Princess responded. You seem to be concerned about Un and or Princess' reputation yet you haven't said what your relationship is to either of them. So why are you so concerned if neither of them is calling their lawyers? I just dont understand
why you are so concerned. You have to admit for a "total stranger" to feel compelled enough to call a lawyer because someone they don't know was possibly slighted seems a little weird. Actually thats a LOT weird.

2) Why would you continue to come in here if you feel so outraged by the way things are run here? I mean if the forum offends you why not go elsewhere
or find another hobby instead of subjecting yourself to the torture of coming here?

3) I don't know who your lawyer is but my guess is he isnt very good. Nobody has said anything that would constitute slander in any post in this thread. While guessing someones identity might be a forum faux-pas it certainly isn't against the law. Other than that I think the worst comments were "wtf?' and calling someone a "beeeetch" and they were both direct quotes from Princess.

4) Lastly, I am sure you by now have already complained to the H/M so what exactly are you looking for? Would you like the forum to be shut down because you dont seem to be making any friends here? There are numerous people here who contribute on a regular basis and get into give and takes with other posters without complaining or calling their lawyers. I have had people call me a lot worse than "beeetch" and have called others worse but everyone just seems to roll with the punches and move on. You on the other hand seem to have some hidden agenda or just an axe to grind. So I'd like to know what exactly do you hope to get out of this?
samy0
BTW- I dont need your legal aid lawyer sending me any cease and desist letters. What I am trying to do is clear the air and find out what you are trying to do or what you hope to accomplish instead of 15 different pi$$ing contests in a thread that was started by a little girl that can't even read her thread now without having to see all the adults acting like morons. Personally if whoever Princess is wouldn't have started all this crap no rules or laws would have been broken. So its hard to have any pity for them or her when they basically asked for it.

In order for "defamation" to actually occur I would think that that so-called defamation would have to actually affect a "real" person. An Internet personnae, where no actual names have been revealed, could not possibly be "defamed".

You need to search for Chip Stewart's posts on here addressing "defamation". He was kind enough, when he was still posting here, to address that situation.

If you feel so personally violated, in your internet personnae, you can choose to not post here anymore. That way, there is no harm, no foul.

It's really a shame that an innocent topic gets so screwed up because of the personal biases of a couple of posters with their own personal agendas.

BTW, nice cut and paste from your googled site. I'm not sure any lawyer would even take the time to personally address your imagined persecution.

For a real example of what might be considered defamation of character I'd like to submit the following post from the thread about our esteemed councilwoman Mrs. Cromer and this is a DIRECT QUOTE.

"Area we just might know each other you took the words right out of my mouth with this comment [ And I've heard some dirty little secrets myself about Ms. Cromer, from her younger days.] Send me a PM so we can swap Kellys dirty little secrets around. I'm looking forward to talk with you."

This post is by none other than Boldwoman herself! It seems to me pretty hypocritical of you to come on this thread and bitch and moan about slander and liable when you yourself are guilty of the same thing in another thread! While anything said in this thread isn't even close to being slanderous or libelous your post about Mrs. Cromer definitely fits the bill for slander. Maybe Modsquad should jump on this and make sure Mrs. Cromer is aware of you sullying her good name. Who knows she might even get YOUR lawyer to sue you! laugh.gif

btw- Modsquad did a fantastic job of upholding the rules and editing your post dont you think?

WHY is it that the people who grab the biggest shopping carts at the grocery store (i.e., the ones with the plastic car added on the front for the kiddies to ride in) are the ones who most often cluelessly park their carts across the end of the aisle, preventing other shoppers from getting into or out of the aisle? mad.gif Lady, I sooooo wanna ram your cart and startle your children (but just a teeny bit).

Man, that is a good one, checks! A real head-scratcher.

Why does the food at a restaurant always materialize while you're in the bathroom? If we go out to dinner, and it seems like the food's taking too long to come out, one or the other of us intentionally gets up to go to the restroom in order to "summon" the food. We call it "making bathroom magic". biggrin.gif

I think it is the density. There's not enough density of "soap and water" around the air, and you can't color air! wink.gif biggrin.gif laugh.gif LOL At least I think huh.gif . Just "theory-izing" laugh.gif .

Princess- I think it might be because people are trying to get rid of the cheap (translation "easy-to-break or "not-of-good-quality-things" in their case) things so that way they can A) con you into buying "more stuff", B ) bring more expensive things into their stock or "making room", or C) making it seem like they're doing a big favor biggrin.gif so you'll come back and RESULT) buy more stuff. I'm guessing on this one wink.gif .

We would have some nasty eye contact if that were my gramma you were excusing!

I take my gramma grocery shopping. She would drive me up the wall if I were another customer. She parks her cart anywhere with no regard for anyone. She just doesn't realize it. She's all comparing labels and bitching about prices and asking me how school is going when other people want to zoom around her. Normally, someone is there navigating the cart for her and is careful of the traffic patterns in the aisles. Sometimes though, if I've dropped her off at the door and parked and then come in to find her...no doubt I've walked into a situation where I want to irrationally punch a customer in the face for not minding my gramma's space and giving her dirty looks and bumping her cart!

It gets on my nerves too, but you had better never do it my gramma! mad.gif When I'm alone, I've learned to circumnavigate grocery stores like I'm friggin' Ms. PacMan.

I've had some home-made soap without bubbles and the soap-maker said that bubbles aren't necessary. It's the soap that makes you clean, not the bubbles. The bubbles are just an additive because most people do not think they are clean unless there are bubbles.

Heather! Clever didn't say anything about grandmas, she said this:

WHY is it that the people who grab the biggest shopping carts at the grocery store (i.e., the ones with the plastic car added on the front for the kiddies to ride in) are the ones who most often cluelessly park their carts across the end of the aisle, preventing other shoppers from getting into or out of the aisle?

She's talking about the inconsiderate soccer moms who are in thier own world 24/7 and don't think of anyone else but their families. THEM I will scare the shite out of in a heart beat.

I have other people's grandmas asking me to get something off the top shelves all the time. And if theres a cluster of them in the isle I'll give them an : Excuse me Ladies wink.gif
I was taught to respect my elders biggrin.gif
CleverNameGoesHere
No worries, WVD, I took no offense at Heather's grandma anecdotes. biggrin.gif That's just part of grocery shopping, having to navigate around elderly folks (and non-elderly) who are oblivious of their surroundings. And I helpfully retrieve items that they can't reach, too. (Since I'm only 5' tall I anticipate being hobbit-sized by the time I'm in my 60's, so hopefully some kind-hearted "young person" will do the same for me someday.) However, it does just annoy me to no end when people who SHOULD be aware of their surroundings (i.e., moms with the ginormous cart which they pick out to make their kids happy) aren't considerate of others in the aisles. They drove there, right? And had to share the lanes in the streets and parking lot with other vehicles? Same rules of cooperation in traffic apply to grocery cart traffic IMHO. Look before you zip out of the aisle, don't take up the whole aisle, etc.

If I need to go down a crowded aisle, I typically leave my cart up at the end, out of the way, and just walk down to grab my pasta or taco shells, so I don't contribute to the traffic jam. But then again, I AM a wonderful human being... rolleyes.gif

In all seriousness it dismays and depresses me that there's such a "me" mindset in our culture and it affects every single thing you do where you have to interact with other people. Hubby's so fed up with it he wants to go live in a cave or a backwoods cabin, Unabomber-style. He's fed up with mankind and its aisle-blockin' ways. ph34r.gif
WVDragonlady
That sounds like another topic for a thread... our culture's mindset.

I agree with your hubby. I'd truely like to move to the mountains of Vermont, near the Canadian border. I have nothing here to hold me ( except some graves), but my hubby won't go for it. He still has family living rolleyes.gif biggrin.gif
