Facing false or trivial allegations of child abuse and neglect? We can help.

Family Rights WV is a grassroots advocacy group with website and support group dedicated to Child Safety, Family Preservation, Family Rights and Child Protective Services (CPS) reform through public information and education.

There have been cases where children have been seized by Child Protective Services unjustly and unnecessarily due to false allegations or extremely trivial allegations of child abuse and neglect which do not merit governmental interference. Critics suggest that these unnecessary removals of children from their natural families and homes are due to perverse federal financial funding streams which promote removals of children instead of family preservation measures.

There have been actual cases reported in WV and nationwide where children have been seized by CPS due to children having birthmarks which were wrongfully reported as bruises; where poverty has been confused with "neglect" (In WV and many other states, conditions directly related to poverty are not to be considered abuse or neglect); where homes were in disarray from spring cleaning, remodeling and while moving into or out of a residence and this was wrongfully reported as neglect due to the condition of the home.

"Q: Isn't foster care used only in the most severe cases of abuse?
A: No. Although some parents really are brutally abusive or hopelessly addicted, many more are not. Some accused parents are innocent of any wrongdoing. In other cases, the family is poor, and that poverty has been confused with child "neglect." In still other cases, the parent is neither all victim nor all villain, but any problems in the family could have been solved with the right kind of help, while keeping the family together safely.We believe that no child should ever be removed from the child's family for neglect alone, unless the child is suffering, or is at imminent risk of suffering, identifiable, serious harm that cannot be remediated by services."

There are many ways for parents to become very pro active in their own cases and to effectively assist their attorneys in preparing their legal defenses for false or trivial allegations of child abuse and neglect.

Family Rights WV strives to provide free information for parents for the State of West Virginia specifically and nationwide, resources, pro se forms, example motions and affidavits, caselaws, informative and helpful links and information in general on how parents can effectively fight false allegations or trivial allegations of child abuse and neglect.

COSTS TO TAXPAYERS

Dr. Susan Orr, Associate Commissoner Children's Bureau in Policy Study No. 262, October 1999,Child Protection at the Crossroads: Child Abuse, Child Protection, and Recommendations for Reform http://www.rppi.org/socialservices/ps262.html
pointed out that placing children in foster care cost taxpayers over 10 times more than if children were left with their natural families and the family received a welfare check:

"Although much public attention has focused on the cost of public assistance (the former AFDC program), child welfare is a more expensive governmental activity and the more complicated. In 1995, the federal government spent about $11,698 per child in foster care, whereas it spent only $1,012 for each person receiving welfare benefits. When factoring in state costs, the average cost increases even further to $21,092 per child in foster care versus $2,499 for each person receiving a welfare check. "

More current figures listed on the National Coalition of Child Protection Reform http://www.nccpr.org indicates there was testimony presented to a Herger Hearing House Ways and Means Human Resources Subcommittee that foster care costs taxpayers over nine times as much than leaving children safely with their natural families.

CPS INVESTIGATION - STORIES FROM PARENTS/FAMILIES NEEDED


House Speaker Bob Kiss has indicated that he plans to initiate a investigation into Child Protective Services during a legislative interims session in May apparently due to the death of a newborn infant due to complications from hypothermia after CPS failed to authorize having the heat turned back on for a mentally challenged mother and due to a number of complaints by falsely accused parents.

Lawmakers may also investigate the Dec 16, 2004 death of a newborn Raleigh County baby but will wait until an internal investigation by WV DHHR is completed before deciding how the legislative investigation may be completed.

West Virginia parents/families who have had trouble with CPS should submit their stories to Bob Kiss so that this investigation will proceed.

Jerry Rigier and two top aides left CPS in Florida in 2004 amid allegations of accepting bribes and kickback from service providers to CPS.

In Los Angeles County alone, Mr. Anderson points out that "...$9 million in unallowable or questionable expenses by the private foster-care agencies that have contracts with Los Angeles County..."Our taxdollars are being spent on "ghost foster children", children who have left the foster care system years earlier, but officials are still billing for these children (to the tune of $35,400 in the case of one child); taxdollars being spent on luxury vehicles for officials, lingerie, fine dining, alcohol, jewelry, parties, vacations, antiques, artwork, memberships to posh country clubs, LOBBYING AND CAMPAIGN CONTRIBUTIONS, cigarettes, liquor, pet food and a church donation and much more... all under the "guise" and "noble facade" of "saving children".

Many are earning their living and many are living lavish lifestyles literally off the backs of American Children not only in Los Angeles but THROUGHOUT THE U.S....and just How many of these children are in the foster care system unjustly, unnecessarily, and even illegally in the first place?

One owner of a private foster care agency, Elias, was paid over $1.6 million over 5 1/2 years.
He was accused of placing children in a foster home with broken windows, one toy and not enough food, clothes or furniture. Elias, the state noted, owned that home and rented it to a foster parent.

It's YOUR tax dollars. The children being exploited for federal funds this brings cps departments are the future of YOUR America.
