MARTINSBURG, W.Va.—A 19-year-old man was arraigned Friday on one count of third-degree sexual assault stemming from a sexual relationship that police allege involved a 13-year-old girl, according to Berkeley County Magistrate Court records.
Police were notified Sept. 11 by the state Department of Health and Human Resources that the girl was pregnant by her boyfriend, Dustin Dwayne Custer of 3521 Charles Town Road in Kearneysville, W.Va., according to court records.
The girl told police that Custer had told her he was 16 years old, not 19, when they began dating in January, according to court documents.
Custer told police that the girl had told him she was 16 and that he had told her his actual age when they were dating, according to court documents.
Both indicated they met through Facebook, a popular Internet social network, and had dated for a number of months before breaking up, according to court documents.
Toward the end of the relationship, police said Custer indicated he was told by a friend that his girlfriend actually was 13 years old, but admitted that he still had sex with her after being told her true age, according to court documents.
