MARTINSBURG, W.Va.—A 46-year-old Martinsburg man is accused of sexually assaulting a preteen girl who later discovered she was pregnant, according to Berkeley County Magistrate Court records.
David Glen Canby, of 91 Kilbourne Ave., was arraigned over the weekend by Magistrate Harry L. Snow on one felony count of first-degree sexual assault, according to court documents.
Canby was in Eastern Regional Jail on $50,000 bond Monday night, according to jail records.
Police said Canby gave a statement Saturday indicating he had sex with the girl this summer at his home, according to court documents.
The victim told police that she never had sex with anyone other than Canby, who she alleges covered her mouth, pinned her down and assaulted her when she tried to fight and get him off of her, according to court documents.
The girl told police that Canby said he was sorry the next morning and asked her not to tell anyone about the incident, according to court records.
Both the girl and Canby indicated that they only had sex one time, according to court documents.
The girl’s mother told police Friday that her daughter had been “made fun of” at school for gaining weight, according to court documents.
The girl’s mother indicated that Canby bought a pregnancy test for the girl, and when the girl took the test the result was positive, according to court documents.
