A Berkeley County Circuit Court judge has set a trial date of Aug. 23 for a Hagerstown man charged in the Jan. 15 shooting death of Damon M. Scott.
Brock Jerome Smith, 22, who was arraigned Friday by presiding 23rd Judicial Circuit Judge Christopher C. Wilkes on one count of murder, entered a not-guilty plea to the charge. Smith was represented by defense attorney Sherman Lambert at the hearing.
Co-defendant Dionnday M. Anderson's arraignment Friday was postponed at the request of his attorney. Anderson is charged with making a false statement to a law-enforcement officer.
Anderson allegedly told the Berkeley County Sheriff's deputy that he was passed out in the vehicle when Scott was shot outside Club Zero, which operated at 1774 Winchester Ave., just south of Martinsburg.
A witness told police that Smith shot Scott, who was also known as "Gotti, in self-defense after Scott pulled a gun on the defendant and attempted to rob him, according to court documents.
