The botched robbery happened Saturday around 2:30 a.m., near Utica Avenue and Avenue M in Flatlands.

According to investigators, the victim and a woman, reported to be his sister, were inside the taxi, when Magnan approached the vehicle, which was stopped at a traffic light. That's when police say he tried to hold up the driver for money. When the cabbie didn't comply, the two got into a struggle. The suspect is alleged to have fired into the livery cab as he was running from the scene.

He ducked into a club, but a bouncer flagged down a cop, and he was arrested.

The victim was shot in the head; he was rushed to Kings County Hospital Center where doctors list him in critical condition. The driver is fine; he picked up the fares on East 56th Street. They were headed somewhere in Downtown Brooklyn.
