    <strong><em>Q: Pennsylvania's law banning texting while driving, with a $50 fine as the penalty, went into effect on March, 8 2012. Once pulled over, how is it determined that drivers were in fact texting if they contend they were not doing so? And by what means will the officer prove the driver was texting? Can the officer take the phone to check it for a prohibited text message? I know that other states have banned texting, but I'm interested to know how it is proven that texting really occurred.
